Income Tax · Missed Deadline

ITR Penalty After Due Date (India, 2026)

Missing the income tax return deadline is not the end of the road, but it does cost you. You usually can still file a belated return, with a late fee and interest, and if even that window has closed, an updated return may be possible with extra tax. This explainer sets out what you pay, what you lose, and how to get back on track after the due date.

Quick reference
  • Belated return: under section 139(4), usually filable until 31 December of the assessment year unless extended.
  • Late fee: section 234F flat fee, broadly up to Rs 5,000, reduced to around Rs 1,000 for income up to Rs 5 lakh.
  • Interest: section 234A interest runs on unpaid tax for the delay, with 234B and 234C in some cases.
  • Lost benefit: most losses cannot be carried forward if you file late; refunds can be delayed.
  • ITR-U: if the belated window has closed, an updated return under 139(8A) may be possible with additional tax.
  • Section numbers may change: the Income-tax Act 2025 is replacing the 1961 Act; confirm current references.

01You can still file: the belated return

If you miss the original due date, you can usually file a belated return under section 139(4). The belated window generally runs until 31 December of the assessment year, unless the government extends it. So for a normal year, missing the mid-year deadline still leaves a few months to file belatedly.

A belated return is a valid return and is better than not filing at all. It carries a late fee and interest, and a few restrictions, but it gets you compliant and lets you claim any refund due. For the exact deadline, see the income tax ITR last date.

02The late fee and interest

Filing late costs you in two ways, which people often confuse.

ChargeUnderBroad position
Late filing feeSection 234FA flat fee, broadly up to Rs 5,000, reduced to around Rs 1,000 if total income is up to Rs 5 lakh
Interest on unpaid taxSection 234AInterest for the delay period on tax still owed, with 234B and 234C in some cases

The flat fee is fixed; the interest keeps growing until you pay. So clearing the tax sooner limits the interest even if the return itself goes in a little later. For a closer look at the fee alone, see the ITR last date explainer.

03What you lose by filing late

Beyond the fee and interest, a belated return costs you some flexibility:

  • Carry-forward of losses: most losses, such as business losses and capital losses, cannot be carried forward to future years if you file late. House property loss is an exception that can still be carried forward.
  • Delayed refund: your refund, and the interest on it, can be delayed when you file late.
  • Regime choice limits: for some taxpayers, the ability to opt for a particular regime depends on timely filing, so filing late can lock you into the default.

These are the quiet costs of filing late. For someone with a loss to carry forward, missing the due date can be far more expensive than the flat fee suggests.

04If the belated window has closed: ITR-U

If even the belated deadline has passed, you may still be able to file an updated return (ITR-U) under section 139(8A). This route has been widened, and the window to file an updated return now extends up to a number of years from the end of the assessment year, as notified.

An ITR-U comes with additional tax on top of the normal tax and interest, and the additional amount rises the later you file. It also cannot be used in every situation, for example to claim or increase a refund. It is a way to come clean and report missed income, not a free second chance.

Belated first, updated as a fallback

If you are still within the belated window, use a 139(4) belated return, which is cheaper. The ITR-U route, with its extra tax, is for when the belated window has already closed.

05How to file after the due date

The steps run through the e-filing portal at incometax.gov.in.

  1. Work out your income and tax, and compute the 234F fee and 234A interest.
  2. Pay the tax, interest and fee as a self-assessment payment.
  3. File the belated return under 139(4), or the updated return under 139(8A) if the belated window has closed, quoting the challan.
  4. Complete e-verification so the return is treated as filed.
  5. Save the acknowledgement and set a reminder for next year's deadline.

Company and LLP filers should also watch their separate ROC deadlines; see the AOC-4 and MGT-7 due dates.

06How Claw Tax helps

Claw Tax and Accounts is an online tax, GST and accounting service for India that connects you with a verified chartered accountant at a fixed, published price, with a Claw reviewer checking every filing before it is submitted.

If your return is simple and you are inside the belated window, computing the fee and filing yourself on the portal is free of any professional charge. Help is worth it when there is unpaid tax and interest to settle, a loss you hoped to carry forward, or the belated window has closed and you are weighing an updated return with its extra tax.

With Claw Tax and Accounts, a verified chartered accountant computes the fee, interest and any additional tax, files the belated or updated return at a fixed published price, and a Claw reviewer checks it before submission. You also get reminders before future deadlines so a late filing does not repeat.

This is not tax advice; a verified CA handles your specifics.

07Frequently asked questions

Can I still file my ITR after the due date?

Usually yes. You can file a belated return under section 139(4), generally until 31 December of the assessment year unless the government extends it. It is a valid return and better than not filing, but it carries a late fee and interest and some restrictions, such as the loss of most loss carry-forwards.

What is the penalty for filing ITR after the due date?

There is a flat late fee under section 234F, broadly up to Rs 5,000, reduced to around Rs 1,000 if your total income is up to Rs 5 lakh, plus interest under section 234A on any unpaid tax for the delay period. Confirm the current amounts for your assessment year.

What do I lose by filing a belated return?

You generally lose the ability to carry forward most losses, such as business and capital losses, to future years, though house property loss is an exception. Your refund and the interest on it can also be delayed, and for some taxpayers a late filing can limit the choice of tax regime.

What if even the belated deadline has passed?

You may be able to file an updated return under section 139(8A), the ITR-U, whose window now extends several years from the end of the assessment year as notified. It carries additional tax that rises the later you file, and it cannot be used in every case, such as to claim or increase a refund.

Does filing late affect my refund?

It can. A belated return is still eligible for a refund, but processing and the interest on the refund can be delayed compared with filing on time. If you are due a refund, filing sooner, even if late, is better than waiting further.
