How To File ITR U (India, 2026)
ITR-U is the updated return that lets you fix a missed or wrong income tax return after the normal deadlines have passed. It exists so you can come forward, declare income you left out, and pay the tax with an additional amount, rather than waiting for the department to find it. This guide explains what ITR-U is, how long you have, how much extra tax it costs, the cases where you cannot use it, and how to file it step by step.
- What: ITR-U is the updated return under section 139(8A) to fix a missed or wrong return.
- Window: an extended period from the end of the relevant assessment year (confirm the current span).
- Extra tax: tax and interest plus an additional percentage that rises the later you file.
- Only to pay more: cannot reduce income, claim or increase a refund, or create a loss.
- File: on the income tax portal with the applicable ITR form, then e-verify.
- Earlier is cheaper: the additional tax steps up over the window.
01What ITR-U is
ITR-U is the updated return allowed under section 139(8A) of the Income-tax Act. It lets you file a return, or correct one you already filed, after the normal and belated or revised return deadlines have gone.
The purpose is voluntary compliance: if you missed filing, or under-reported income, you can set it right by paying the tax due plus an additional amount, instead of risking the department catching it later with heavier consequences.
02How long you have to file
ITR-U has an extended window measured from the end of the relevant assessment year. This window was widened, so you now have longer than before to file an updated return.
As currently provided, you can file ITR-U up to a set number of years from the end of the relevant assessment year, with the additional tax increasing the later you file. Confirm the exact window for your assessment year on the portal, because it has been revised.
Later means costlier
The additional tax on an updated return goes up in steps the longer you wait. Filing earlier in the window costs less additional tax than filing near the end of it, so if you know you need to file ITR-U, doing it sooner is cheaper.
03The extra tax you pay
ITR-U is not just the tax you owe. On top of the tax and interest, you pay an additional amount calculated as a percentage of the tax and interest due, and that percentage rises the later you file.
| When you file ITR-U | Additional tax (as notified) |
|---|---|
| Earlier in the window | A lower additional percentage of tax and interest |
| Later in the window | A higher additional percentage of tax and interest |
The steps rise over the window (for example a lower percentage in the earlier years and a higher percentage in the later years). Because the figure is set by law and has been revised, confirm the current percentage for the year you are filing before you pay.
04When you cannot file ITR-U
ITR-U is only for coming forward and paying more. You cannot use it to:
- Reduce your income from what was already reported.
- Claim or increase a refund.
- Turn a return into a loss, or increase a loss.
- File where it would reduce your total tax liability.
There are also situations tied to search, survey or ongoing proceedings where an updated return is not allowed. In short, ITR-U works when the correction increases your income and tax, not when it benefits you.
If your situation is a plain missed return within the normal window, a belated or revised return may be the better route. The detailed walkthrough is in how to file ITR-U online.
05Step-by-step to file
- Log in to the income tax portal at incometax.gov.in.
- Work out the correct income and the tax and interest due for the assessment year.
- Calculate the additional tax at the percentage that applies to when you are filing.
- Pay the full amount (tax, interest and additional tax) and keep the challan.
- Fill ITR-U with the applicable ITR form, state the reason for updating, and attach the payment details.
- Submit and e-verify within the time allowed.
ITR-U only works one way: you can pay more, not get more. If a correction would cut your tax, increase a refund or create a loss, ITR-U is not the form for it.
06How Claw Tax helps
Claw Tax and Accounts is an online tax, GST and accounting service for India that connects you with a verified chartered accountant at a fixed, published price, with a Claw reviewer checking every filing before it is submitted.
If you simply missed a straightforward return, you may be able to file ITR-U yourself on the government portal once you have worked out the numbers. Claw Tax is for getting those numbers right, because the cost of an updated return turns on the correct income, interest and the additional tax percentage for your filing date, and on confirming that ITR-U is even the right route rather than a belated or revised return.
A verified chartered accountant from a network of 300+ partner CAs can compute the tax, interest and additional amount, prepare the updated return and file it at a fixed, published price, with a Claw reviewer checking it before submission. See the services and prices at clawlaw.in/tax.
This is general information, not tax advice; a verified CA handles the specifics of your case.
07Frequently asked questions
What is ITR-U?
ITR-U is the updated return allowed under section 139(8A) of the Income-tax Act. It lets you file a return you missed, or correct one you already filed, after the normal and belated or revised return deadlines have passed, by paying the tax due plus an additional amount. It exists to let taxpayers come forward voluntarily rather than wait to be caught.
How long do I have to file ITR-U?
ITR-U can be filed within an extended window measured from the end of the relevant assessment year, which has been widened over time. The additional tax rises the later within that window you file. Confirm the exact span for your assessment year on the income tax portal, as it has been revised and depends on the year.
How much extra tax do I pay on ITR-U?
On top of the tax and interest due, you pay an additional amount calculated as a percentage of that tax and interest, and the percentage increases in steps the later you file within the window. Because the slabs are set by law and have been revised, confirm the current percentage for your filing date before you pay.
When can I not file ITR-U?
You cannot use ITR-U to reduce your income, claim or increase a refund, create or increase a loss, or otherwise reduce your total tax liability. It is only for corrections that increase your income and tax. Certain cases tied to search, survey or ongoing proceedings are also excluded from the updated return route.
Is ITR-U the same as a revised return?
No. A revised return corrects a return within the normal revision window and can reduce or increase figures. ITR-U is for after those deadlines, carries additional tax, and can only be used to pay more. If you are still within the revision window, a revised return is usually the better and cheaper route than ITR-U.
Do I have to pay before filing ITR-U?
Yes. You first compute the correct income, the tax and interest due and the additional tax for your filing date, pay the full amount, and keep the challan. You then file ITR-U with the applicable ITR form, state the reason for updating, attach the payment details and e-verify. An ITR-U without the tax paid is not valid.
