Birth and Death Certificate Download in West Bengal: Online Process, Correction, and Late Registration (2026)
How to download a birth or death certificate online in West Bengal, what to do when the record is wrong, and how late registration works, with the steps and the legal route if the authority refuses.
How-To · West Bengal Civil Registration
You need a birth or death certificate in West Bengal, and the form is asking for it today. For most people the record already exists, and you can download a digitally signed copy online in a few minutes. The trouble starts when the name or date is wrong, or when the birth or death was never registered at all. This guide covers all three situations: the normal download, correction of a wrong entry, and late registration. It also explains when a refusal becomes a legal matter. Last verified: October 2026.
- Download: log in on the West Bengal Janma-Mrityu Tathya portal, search the record, and download the digitally signed PDF.
- Wrong entry: file a correction application with an affidavit and supporting proof.
- Never registered: late registration needs the District Registrar’s permission after 30 days, and a magistrate’s order after one year.
- If refused: it becomes a legal dispute. Keep the refusal in writing and track every order.
01The short answer
To download a birth or death certificate in West Bengal, open the state civil registration portal (Janma-Mrityu Tathya), log in with your mobile number and OTP, search by registration number or by name and date, check the details, and download the digitally signed PDF. Any citizen can usually apply, and the fee is small or nil for a simple download. If the record is wrong, you need an affidavit and a correction application. If it was never registered, you need late registration, which may need a magistrate’s order.
Two systems, one record
Births and deaths in India are registered under the Registration of Births and Deaths Act, 1969. West Bengal runs its own state portal and rules, and also feeds the national civil registration system. If your record is in West Bengal, start with the state portal.
02How to download a certificate online (steps)
The steps are the same for a birth certificate and a death certificate. Only the menu you pick is different.
- Open the portal. Go to the West Bengal Janma-Mrityu Tathya portal: janma-mrityutathya.wb.gov.in.
- Register or log in. Under Citizen Services, register with your mobile number and confirm the OTP. Use a number you can access, because the OTP is needed each time.
- Choose Birth or Death. Pick the Birth or Death menu, then select the option to download or search for a certificate.
- Search for the record. Enter the registration number if you have it. If not, search by the name of the child or the deceased, the date of birth or death, and the place or registration unit.
- Check every detail. Read the name, date, place, and the parents’ names carefully. A small spelling error here is the start of most problems later.
- Pay if asked, then download. Complete any fee shown on screen and download the digitally signed PDF. Save it, because the QR code on it can be used to verify the certificate.
If the search shows no result, do not assume the record is missing. Try other spellings, try the date in a different format, and check whether the event was registered in a different municipality or block than you expect. Only if every search fails should you treat it as unregistered.
03Certificate types, where to get them, and the fee
| Certificate / request | Where | Fee (verify before paying) |
|---|---|---|
| Birth certificate, existing record | West Bengal Janma-Mrityu Tathya portal (online download) | Small or nil for download; confirm on the portal |
| Death certificate, existing record | West Bengal Janma-Mrityu Tathya portal (online download) | Small or nil for download; confirm on the portal |
| Correction of a wrong entry | Local Registrar (municipality, panchayat or block), with affidavit and documents | Varies; ask the Registrar |
| Late registration, after 30 days and within 1 year | Registrar, with written permission of the District Registrar or the authorised officer | Late fee of Rs 50 under the Rules |
| Late registration, after 1 year and within 2 years | Registrar, on an order of a District Magistrate, Sub-Divisional Magistrate or authorised Executive Magistrate | Late fee of Rs 100 under the Rules |
Fees and routes can change by rule or notification, so treat the table as a guide and confirm on the official portal or with your local Registrar.
04If the record is wrong: correction of a name or date
A wrong child’s name, a wrong date, or a misspelt parent’s name is common, and the certificate you download will simply repeat the error. The law lets the Registrar correct an entry that is wrong in form or substance, but it expects proof.
What you usually need
- An application to the Registrar who holds the record, stating exactly what is wrong and what it should be.
- A sworn affidavit setting out the correct details. For the format and rules, see our guide to the name change affidavit format.
- Supporting documents, such as a school record, hospital record, parents’ identity proof, or a medical certificate of the cause of death for a death entry.
- A copy of the existing certificate showing the error.
What happens next
The Registrar checks the papers and, if satisfied, corrects the entry and a fresh certificate can be downloaded. Small clerical errors are usually the easy case. Changing a name completely, or changing a date by a large gap, gets more scrutiny and may be refused.
Keep copies of everything
Keep a dated copy of your application and the acknowledgement. If the Registrar refuses or does not reply, those papers are the base of any later challenge.
05If it was never registered: late registration
The law expects a birth or death to be reported within 21 days. After that, registration is still possible, but the route gets stricter as time passes.
- Within 21 days: normal registration, with no late fee.
- After 21 days but within 30 days: registration with a late fee.
- After 30 days but within one year: registration only with the written permission of the District Registrar or the officer authorised for this, plus a late fee (Rs 50 under the Rules).
- After one year: registration only on an order of a District Magistrate, Sub-Divisional Magistrate or an authorised Executive Magistrate, plus a late fee (Rs 100 under the Rules for the first two years).
This follows Section 13 of the Registration of Births and Deaths Act, 1969, as applied by the West Bengal Rules.
Documents for a delayed registration
Expect to provide proof that the birth or death really happened at that place and time: a hospital or nursing home record, a school or vaccination record, parents’ identity proof, an affidavit, and for a death, a cremation or burial record or a medical certificate. The older the event, the more proof the authority will want.
Where an order from a magistrate is needed, the authority will first verify the facts, and may call for a local inquiry before it passes the order. Once you have the order, you go back to the Registrar with it, and the record is entered.
06When a refusal becomes a legal dispute
Most corrections and late registrations end at the Registrar’s desk. But some do not. The Registrar may refuse, the magistrate may reject the application, or the matter may sit with no decision. At that point it is no longer a form problem. It is a legal dispute.
Your options then depend on who refused and why. You can appeal or apply to the higher authority named in the Rules, or approach the High Court under Article 226 of the Constitution if there is no other remedy and a right is being denied. Courts in India have, in many cases, directed Registrars to correct or register an entry where the proof was clear. A lawyer can tell you which route fits your facts.
Two practical points. First, keep the refusal in writing, with the reason. Second, note every hearing date and every order, because a missed date in a small matter can undo months of effort.
07Common mistakes to avoid
- Giving up after one failed search. Try spelling variants, a different date format, and the right registration unit before you treat the record as missing.
- Using an affidavit that does not match the documents. The name on the affidavit, the school record and the ID should agree.
- Ignoring the late-registration route. The longer you wait, the more proof is needed. Start early.
- Paying agents for an online download. The download itself is a self-service step on the official portal.
- Not saving the acknowledgement. It is your proof of when you applied.
