Jurisdiction Reference · Patents

You are about to file a patent in India and the form asks for the "appropriate office". Pick wrong and your hearing notice, examination reports and appeal path can all land in a city you did not plan for. India has four patent offices, and the one that handles your file is fixed by a simple rule about where the applicant is based. This page maps each office to its states and explains Rule 4 in plain words. Last verified October 2026.

The short answer
  • Four offices: Kolkata (head office), Delhi, Mumbai and Chennai.
  • The rule: Rule 4 of the Patents Rules, 2003 picks the office by residence, domicile, place of business or where the invention originated.
  • Kolkata: covers the rest of India not named for the other three.
  • Do not guess: check the office on the IP India status tool.

01Why the patent office matters

The Indian Patent Office is one body with four locations. Each location is a separate working office with its own controllers, its own hearing schedule and its own territory.

For you, three things depend on that territory:

  • Where you file. The application, forms and fees go to the appropriate office.
  • Where hearings happen. Pre-grant and post-grant hearings are held by controllers of that office.
  • Where you appeal. The appropriate office also helps decide which High Court hears a challenge to a decision.

The rule itself is short. The confusion comes from cases where the applicant lives in one state, works in another, and the invention came from a third.

02Rule 4: how the appropriate office is decided

Rule 4 of the Patents Rules, 2003 says the appropriate office is the head office or the branch office within whose territorial limits one of these is situated:

  • the place where the applicant normally resides, or
  • the place where the applicant has a domicile, or
  • the place where the applicant has a place of business, or
  • the place from where the invention actually originated.

If the applicant has no place of business or domicile in India, the office is decided by the address for service in India that the applicant gives. For joint applicants, the first-mentioned applicant is used.

Once the appropriate office is decided for a proceeding, it should not ordinarily be changed. That is why the first filing matters so much.

03The jurisdiction map: four offices, by state

Kolkata is the head office and acts as the office for "the rest of India". The other three cover named states and union territories.

OfficeStatesUnion Territories
Kolkata (head office)The rest of India, meaning all states and territories not named for the other three officesThe rest of India
DelhiDelhi, Haryana, Himachal Pradesh, Punjab, Rajasthan, Uttar Pradesh, UttarakhandChandigarh, Jammu and Kashmir, Ladakh
MumbaiMaharashtra, Gujarat, Madhya Pradesh, Goa, ChhattisgarhDaman and Diu, Dadra and Nagar Haveli
ChennaiTamil Nadu, Kerala, Karnataka, Andhra Pradesh, TelanganaPuducherry, Lakshadweep

Because Kolkata takes "the rest of India", it covers West Bengal and the whole of the North East, Bihar, Jharkhand, Odisha and the Andaman and Nicobar Islands, among others.

04Reading the application number

Many people ask whether the application number tells you the office. Older Indian patent numbers carried a short office suffix such as DEL, MUM, CHE or KOL, for example a number followed by "/DEL/" and the year. That suffix showed the office where the application was filed.

Newer numbers use a numeric format with the year and a serial. Whether a digit group inside the number encodes the office is something you should check on the official application status page rather than guess.

The safe method is to open the application on the IP India status tool. It shows the office name next to the file.

05Common situations

Applicant based in one state, invention made in another

Rule 4 lists residence, domicile, place of business and place of origin of the invention. If they point to different offices, the applicant has to make a reasoned choice based on the facts, and then stay with it.

Company with a registered office in one city and a lab in another

The place of business and the place where the invention originated can sit in different territories. Record in the file why you chose one. A clear record helps if jurisdiction is questioned later.

Foreign applicant

With no place of business or domicile in India, the Indian address for service decides the office. In practice this is usually the address of the patent agent on record.

Several joint applicants

The first-mentioned applicant decides the office. Put the applicant with the strongest connection first.

06Why the office matters for court

Appeals against Controller decisions go to the High Court. Courts have looked at whether the "appropriate office" or the place where the hearing officer sat decides which High Court has the power to hear the appeal. This has been discussed in recent High Court decisions, and commentary notes that the appropriate office, not the hearing officer location, is the guide.

For trademark and GI parallels, the registry office logic is similar but not identical. See how to search Indian trademarks and how to register and track a GI in India. For where IP disputes are heard by courts, see case search across Indian courts.

07Where Claw fits

Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.

For patents, trademarks, designs and GIs, Claw's IPR Solutions tab tracks IP India registry matters, including pending patent annuity and response deadlines, pending hearings from patent and trademark filings, and the related documents, tasks and activities. On the court side, Claw tracks IP litigation across Indian courts that have a case website, including the High Court IP Divisions, and supports IP judgment research over 30 crore+ judgments. That puts the registry side and the court side in one place. Claw covers 9,102 courts, benches and forums, with results in under 5 seconds.

Be clear on the limits. Claw does not yet track copyright registration at the Copyright Office, and for copyright it is court-side only. For global multi-country docketing and annuities, vendors such as Anaqua, Clarivate and Dennemeyer go deeper. For very high volume specialist IP-firm docketing, look at Iolite or JSK. For AI prior-art search, PatSnap, Questel and IPRally are stronger. IP features are bundled in the Premium plan (Rs 1,099 per month or Rs 10,999 per year, excluding GST) or Enterprise, with no separate IP-only plan. Claw does not use customer case documents to train AI models.
