POCSO Act 2012 Section 42a: Act in Addition to Other Laws (2026)

Section 42A of the POCSO Act, 2012 answers a basic question: what happens when POCSO and another law both apply to the same facts. It says the provisions of POCSO are in addition to, and not in derogation of, any other law for the time being in force. And where POCSO is inconsistent with any other law, POCSO prevails to the extent of the inconsistency. This page explains what Section 42A means, how it works with Section 42, how courts have used it, and why it matters in practice. Last verified October 2026.

The short answer
  • What it is: Section 42A is a coordination rule between POCSO and other laws.
  • In addition: POCSO applies in addition to, and not in derogation of, any other law in force.
  • Override: where POCSO is inconsistent with another law, POCSO prevails to the extent of the inconsistency.
  • With Section 42: Section 42 picks the greater punishment on overlap; Section 42A governs how the laws coexist and conflict.

01The short answer

Section 42A is a coordination rule. It tells us how POCSO sits with the other laws that may cover the same conduct, such as the Bharatiya Nyaya Sanhita, the old Indian Penal Code, or the Information Technology Act. It has two limbs:

  • Addition: the provisions of POCSO are in addition to, and not in derogation of, the provisions of any other law in force. POCSO does not cancel the other law.
  • Override on conflict: where POCSO is inconsistent with any other law, POCSO has overriding effect, but only to the extent of the inconsistency.

Section 42A was inserted by the Criminal Law (Amendment) Act, 2013.

02In addition, not in derogation

The first limb means POCSO adds to the existing law rather than replacing it. The same act against a child can be an offence under POCSO and also under the general criminal law. Both can apply together, and an accused can be charged under both.

Two laws, same facts

If an act of sexual assault on a child is an offence both under POCSO and under the general penal law, Section 42A keeps both alive. The prosecution does not have to choose one and drop the other at the charge stage.

03The overriding effect

The second limb decides what happens when the two laws clash. POCSO prevails, but only so far as the clash goes. This is a narrow override, limited to the point of inconsistency, not a blanket repeal of the other law.

So where POCSO lays down a special procedure, a special court, a higher minimum sentence, or a special rule of evidence that cannot stand with a general law, the POCSO rule wins. Everything else in the other law continues to apply as usual.

04Section 42A and Section 42 together

Section 42A often comes up with Section 42, but they do different jobs.

SectionWhat it does
Section 42Where an act is an offence under POCSO and under another law, the offender is punished under the law that provides the greater punishment.
Section 42APOCSO applies in addition to other laws, and overrides them to the extent of any inconsistency.

Section 42 is about which punishment applies when there is overlap. Section 42A is about how the laws coexist and which one bends when they conflict. Courts have said the two operate in different spheres, and Section 42A cannot be used to widen the limited scope of Section 42.

05Why it matters in practice

Section 42A matters whenever POCSO meets another statute. Courts have used it to hold that POCSO's reporting duty prevails over a restriction in the general procedure law, and that POCSO's special rules on sentence and procedure override inconsistent general rules.

For an advocate, the practical lesson is to read POCSO alongside the general criminal law, apply the POCSO punishment sections where they are higher, and treat the POCSO procedure under Section 33 as the one that prevails where it conflicts with the general procedure.

06Key case law

The Karnataka High Court has read Section 42A to mean that POCSO is not in derogation of any other law and has an overriding effect in case of inconsistency, applying it to hold that a sentence below the POCSO minimum could not stand. The Supreme Court, in a 2025 decision, treated Section 42 and Section 42A as operating in different spheres, and held that Section 42A cannot override the scope of Section 42.

The Delhi High Court has also relied on Section 42A to hold that POCSO's reporting provisions prevail over a restriction in the general procedure law.
