Locked Up As A Dangerous Person, Freed Because The Cases Touched Only Law And Order
Gujarat detained a man under its anti-social activities law as a dangerous person, relying on two police cases. The High Court has quashed the detention and ordered him released.
The Court held the offences cited had no bearing on the maintenance of public order. Preventive detention needs more than a breach of law and order: the acts must disturb the even tempo of life of the community, as Ram Manohar Lohia and C. Anita explain. The detaining authority's subjective satisfaction was therefore not legal or valid. The detention order was quashed and the detenu ordered set at liberty forthwith.
- Law and order is the wider circle; public order is narrower. Only the narrower one allows detention.
- A list of criminal cases is not enough to brand someone a dangerous person.
- The test is the effect on the community, not on a few individuals.
- Ordinary criminal law remains available to deal with the cases themselves.

The detention
The detaining authority passed an order on 13 August 2026 detaining the petitioner as a 'dangerous person' under Section 2(c) of the Gujarat Prevention of Anti-social Activities Act, 1985.
The grounds referred to two criminal cases registered at Shaherkotda Police Station. The State argued he was a habitual offender whose activities affected society at large.
He argued the cases were at most a law and order problem, with no nexus to public order as the Act requires.
Public order against law and order
Justices Gita Gopi and L.S. Pirzada recalled the Constitution Bench in Dr. Ram Manohar Lohia, where Justice Hidayatullah described three concentric circles: law and order is the largest, public order sits inside it, and security of the State is the smallest. Two drunkards fighting cause disorder, but not public disorder.
In C. Anita, the Supreme Court said public order is the even tempo of life of the community; where the effect is confined to a few individuals, only law and order is involved.
Applying that, the Court held the offences alleged had no bearing on public order, so the authority's satisfaction could not stand.
The result
The detention order was quashed and the rule made absolute.
The detenu was directed to be set at liberty forthwith, if not required in any other case.
Who argued it
Appearances as recorded in the judgment of the Court.
Frequently asked
Can past criminal cases alone justify preventive detention?
No. The Court held these cases had no bearing on public order and quashed the detention.
What is the difference between public order and law and order?
Public order is disturbed only when the act affects the community at large, not just a few people.
Challenging a preventive detention order
- List the cases relied on and what each actually alleges.
- Ask whether they affected the community or only a few individuals.
- Look for any material showing disturbance of ordinary community life.
- Cite Ram Manohar Lohia and C. Anita on the distinction.
