ClawScore · Criminal Background Check
A criminal background check on a person is the exercise of finding out whether an individual is or has been an accused in a criminal case. For an employer hiring into a sensitive role, a lender assessing a promoter, or a partner about to sign, it is a basic piece of diligence. But it has to be done carefully, because a pending case is an allegation, not a conviction, and the presumption of innocence applies. Doing it well in India means knowing where criminal cases show, how FIRs and chargesheets fit in, and how to read the result fairly. This guide sets out the method. Last verified October 2026.
- Search the courts: eCourts for magistrate and sessions courts, plus the High Courts and Supreme Court for appeals, bail and quashing, including Section 138 cheque bounce matters.
- Know the stage: an FIR is an allegation, a chargesheet means prosecution, and only a judgment decides guilt; the presumption of innocence applies.
- Court search is not a police clearance: for a formal character certificate, use the state police route, usually with consent.
- Identity is the discipline: a common name produces false hits, so confirm with a second identifier and verify every match confidence flag.
01The short answer
To run a criminal background check on a person in India, search their name on the case-status systems: eCourts at services.ecourts.gov.in for the magistrate and sessions courts where most criminal cases are heard, and the High Court and Supreme Court portals for appeals, bail and quashing matters. Include cheque bounce complaints under Section 138 of the Negotiable Instruments Act, which are criminal in nature. For a formal character verification, a police clearance through the state police is the official route, which is separate from a court search.
Because people share names, confirm the person with a second identifier such as a father's name or address, and treat a similar-name hit as something to verify, not as proof.
02Where criminal cases show
Criminal matters against an individual are spread across the court system:
- Magistrate and sessions courts, on eCourts, where most criminal trials run; search by party name with the person as accused.
- The National Judicial Data Grid at njdg.ecourts.gov.in, which confirms pendency.
- High Courts and the Supreme Court, for criminal appeals, revisions, bail and petitions to quash an FIR.
- Cheque bounce matters under Section 138 of the NI Act, which are criminal complaints; see Section 138 of the NI Act.
Economic offences, which are a particular kind of criminal matter, are covered in how to check economic-offence cases on a company or director.
03FIR, chargesheet and the new codes
A criminal case moves through stages, and the stage matters for how you read it:
- FIR: the first information report, the start of a police investigation. It is an allegation, and it may or may not lead anywhere.
- Chargesheet: filed if the police find enough to prosecute; the matter then goes to court.
- Trial and judgment: where guilt is actually decided.
Since 1 July 2024, India's criminal laws changed: the Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam replaced the old Indian Penal Code, the Criminal Procedure Code and the Evidence Act. Older cases still carry the old section numbers, so a search spans both. See the new criminal laws.
04Court search versus police verification
These are two different things, and a careful check knows which it is using:
| Method | What it gives | Limits |
|---|---|---|
| Court case search | Cases where the person is named as accused, by court | Depends on digitised records and correct name matching |
| Police verification / clearance | An official character certificate from the state police | Consent-based, slower, used for employment and visas |
A court search is fast and broad but relies on name matching and on records being online. A police clearance is the official route for a formal character check, usually with the person's consent. Serious hiring often uses both.
05Reading the result fairly
A criminal background check is where fairness matters most, because the cost of a mistaken identity or a misread allegation falls on a person:
- A pending case is an allegation. The presumption of innocence applies until a court decides.
- Read the stage and the section: an FIR that went nowhere is different from a chargesheet or a conviction.
- Confirm identity hard: a common name produces false hits, so match on more than the name alone.
The biggest risk in a criminal background check is not missing a case. It is attaching the wrong person to one. Identity matching is the whole discipline.
06What a clean result actually means
A clean result means no case was found in the court records you searched, on the date you searched, under the names you used. It does not rule out a case under a different spelling or a former name, a matter in a court whose records are not online, an FIR at the investigation stage not yet in a court portal, or a case filed later.
Confirm identity with a second identifier, read every hit for stage and section, respect the presumption of innocence, record what you covered, and use a police clearance where a formal certificate is needed. This is research to inform a decision, not legal advice, and it must be used lawfully and fairly.
07Where Claw fits
Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
ClawScore, at clawscore.clawlaw.in, is Claw's litigation and criminal-risk service, and criminal exposure is central to what it reports. You give it a person's name and it searches every matter across 9,102 courts, benches and forums and returns one scored Excel workbook: a Summary tab with a ClawScore risk band (Clean, Low, Moderate or High), a Matters tab that includes criminal and cheque bounce cases, a Related parties tab, and a Coverage tab recording what was searched. Every finding carries a MATCH CONFIDENCE, which matters more here than anywhere else, because a common name produces false hits and the cost of attaching the wrong person to a criminal case is high; the confidence flag tells you what to verify rather than presenting a namesake as certain. Its Constant Monitoring runs daily, weekly or monthly scans on a watched list and reports what is New, Changed or Closed. It draws on 30 crore+ judgments, with Supreme Court decisions from 1950 and High Court decisions from 1990, and returns results in under 5 seconds. Claw does not train its AI models on your documents. A court search is not a substitute for an official police clearance where one is required, and a pending case remains an allegation.
Create a FREE Claw account to run a criminal and litigation check on a person and set up monitoring, and use case search across Indian courts to surface criminal and other matters naming the individual.

09Frequently asked questions
How do I run a criminal background check on a person in India?
Search the person's name on eCourts for the magistrate and sessions courts, and on the High Court and Supreme Court portals for appeals, bail and quashing, including Section 138 cheque bounce complaints. For a formal character certificate, apply for a police clearance through the state police, which is a separate, consent-based route.
Is an FIR the same as a criminal record?
No. An FIR is the first information report that starts a police investigation; it is an allegation and may not lead to a case. A chargesheet means the police found enough to prosecute, and only a court judgment decides guilt. Read the stage of any matter rather than treating an FIR as proof.
What changed with the new criminal laws in 2024?
From 1 July 2024, the Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam replaced the Indian Penal Code, the Criminal Procedure Code and the Evidence Act. Older cases still carry the old section numbers, so a thorough search spans both the old and the new codes.
Is a court case search the same as a police verification?
No. A court case search finds cases where the person is named as accused, drawn from digitised court records, and is fast and broad. A police verification or clearance is an official character certificate issued by the state police, usually with the person's consent, and is the formal route for employment and visas. Serious hiring often uses both.
What does a clean criminal background check prove?
It proves no case was found in the court records you searched, on the date you searched, under the names you used. It does not rule out a case under a different spelling or former name, a court not online, an FIR not yet in a court portal, or a matter filed later, and a pending case is an allegation, not a conviction.
