How to Get a Legal Heir or Succession Certificate in Uttar Pradesh

When a family member dies, the heirs usually need a document that proves who the legal heirs are, so they can claim a pension, a bank balance, shares, insurance or the transfer of property. In Uttar Pradesh this is not one document but three different ones for different purposes: a legal heir certificate issued by the revenue authority (Tehsildar) through UP e-District, a surviving-member certificate for limited uses, and a succession certificate granted by the civil court under the Indian Succession Act 1925 for debts and securities. This page explains which document you actually need, how to get the legal heir certificate online through edistrict.up.gov.in, when you must instead go to the civil court for a succession certificate or probate, and what happens when the heirs disagree and it turns into a contested matter. 01Which document do you need

DocumentWhat it is forWho issues it
Legal heir certificateIdentifying heirs for pension, PF, service dues, utility and routine transfersTehsildar / revenue authority via UP e-District
Surviving member certificateProving the surviving members of a family for limited purposesRevenue authority
Succession certificateCollecting debts and securities (bank deposits, shares, bonds) of the deceasedCivil court, under the Indian Succession Act 1925
Probate / letters of administrationGiving effect to a will, or administering an estate without a willCivil court

As a rule of thumb: for a pension or a simple transfer, the legal heir certificate is usually enough; for bank deposits, shares and bonds a bank often insists on a succession certificate from the court; and where there is a will, probate may be needed.

02Documents to keep ready

  • Death certificate of the deceased.
  • Identity and address proof of the applicant and of each heir (Aadhaar).
  • Proof of relationship to the deceased (ration card, family register / parivar register extract, school records).
  • An affidavit or self-declaration of the heirs, as the form requires.
  • Address proof of the deceased.

Make sure the names and the relationship match across the death certificate, Aadhaar and the family register, because a mismatch is the main cause of delay.

03Legal heir certificate on UP e-District

The legal heir or surviving-member certificate in UP is a revenue-department service delivered through the e-District portal:

  • Step 1. Register or log in at edistrict.up.gov.in (or apply through a Jan Seva Kendra).
  • Step 2. Select the relevant certificate service (legal heir / surviving member) from the revenue services list.
  • Step 3. Fill the applicant and heir details and upload the death certificate, relationship proof and the affidavit.
  • Step 4. Pay the small service fee and submit; the application goes to the Tehsildar for field verification (often through the lekhpal and kanungo).
  • Step 5. After verification the certificate is issued digitally and can be downloaded and verified online.

Use only edistrict.up.gov.in or an authorised Jan Seva Kendra. Verify the digital certificate through the portal, because many offices now accept only the e-signed version.

04Succession certificate from the civil court

A succession certificate is different: it is granted by a civil court under the Indian Succession Act 1925 and is mainly used to collect the debts and securities of the deceased, such as bank deposits, fixed deposits, shares and bonds. A revenue-issued legal heir certificate does not replace it where a bank or company insists on the court certificate.

  • File a petition before the district civil court having jurisdiction where the deceased ordinarily resided or where the assets are.
  • The court issues a notice, publishes it to invite objections, and holds a hearing.
  • Court fee is payable, usually as a percentage of the value of the debts and securities, as per the state court-fee schedule.
  • If no valid objection succeeds, the court grants the certificate specifying the heirs and their shares.

05Probate and letters of administration

Where the deceased left a will, the executor may need probate of the will from the civil court to act on it; where there is no will or no named executor, an heir may seek letters of administration. Both are court proceedings under the Indian Succession Act 1925, with notice, possible objections and court fee.

Whether probate is compulsory depends on the property, the religion of the deceased and where the will was made, so take advice before assuming a revenue certificate will do. For the mechanics, see the succession certificate explainer.

06When heirs disagree

The certificate process assumes the heirs agree. The moment someone disputes who the heirs are, what the shares are, or whether a will is genuine, it stops being a routine certificate and becomes a contested civil matter:

  • Objections filed to a succession, probate or administration petition are heard and decided by the civil court.
  • A separate partition or declaration suit may be filed to settle shares in the property.
  • A revenue mutation based on a certificate can itself be challenged before the revenue courts.

These are live court proceedings with hearing dates, orders and appeals, and that is where tracking the matter becomes important.

Claw returns results in under 5 seconds, its judgment search spans 30 crore+ judgments (Supreme Court from 1950 and High Courts from 1990) so your advocate can see how similar succession and inheritance disputes were decided, and Claw does not train its AI models on your documents. A clean search result only means nothing was found on the forums and date searched, and this is general information, not legal advice on your family's matter.

To see how similar matters have gone, run a case search across Indian courts.

09Frequently asked questions

What is the difference between a legal heir certificate and a succession certificate in UP?

A legal heir certificate is issued by the Tehsildar through UP e-District and is used for pension, PF, service dues and routine transfers. A succession certificate is granted by a civil court under the Indian Succession Act 1925 and is mainly for collecting the debts and securities of the deceased, such as bank deposits, shares and bonds, where the institution insists on the court document.

How do I apply for a legal heir certificate online?

Log in at edistrict.up.gov.in or go through a Jan Seva Kendra, choose the legal heir or surviving member service, upload the death certificate, relationship proof and affidavit, and pay the small fee. The Tehsildar verifies it, often through the lekhpal and kanungo, before the certificate is issued digitally.

When do I need to go to court instead?

When a bank or company insists on a succession certificate for deposits, shares or bonds, or where there is a will needing probate, or where the heirs disagree. These are civil court proceedings under the Indian Succession Act 1925 with notice, possible objections and court fee.

What court fee applies to a succession certificate?

The court fee is usually a percentage of the value of the debts and securities covered, as per the state court-fee schedule, often with a ceiling. Confirm the current percentage before filing, because it decides the cost of the petition.

What if one heir disputes the others?

The matter becomes a contested civil proceeding. Objections to a succession, probate or administration petition are heard by the civil court, and a separate partition or declaration suit may be filed to settle shares. These carry hearing dates, orders and appeals.

Can I track a contested succession case?

Yes. You can create a free Claw account and track the matter across the civil court that hears it, including the Allahabad High Court and its Lucknow Bench, with hearing dates and orders in one place, and your advocate can search how similar inheritance disputes were decided.
