How to Get a Legal Heir or Succession Certificate in Tamil Nadu
When a family member dies, the surviving family often needs a document that names the legal heirs. In Tamil Nadu this is the legal heir certificate, issued by the Tahsildar through the e-Sevai portal, and it is used to claim a pension, provident fund, gratuity, insurance and to transfer simple assets into the heirs names. It is not the same as a succession certificate, which only a civil court can grant and which you need for the deceased person debts and securities. This page walks through the full flow: what the legal heir certificate is and when it is enough, how it differs from a succession certificate, the e-Sevai steps, the documents, the fee, the timeline, the common reasons it is refused, and the civil court route when the heirship itself is disputed. Last verified October 2026.
- Where: Tamil Nadu e-Sevai at tnesevai.tn.gov.in, under Revenue Department, Legal Heir Certificate.
- Signed by: the Tahsildar, after the VAO and Revenue Inspector verify the list of heirs.
- Use it for: pension, PF, gratuity, insurance and simple asset transfers.
- Not for: bank securities and debts, which need a court succession certificate.
- If heirship is disputed: succession or partition suit in the civil court; Claw can track it.
01Legal heir certificate versus succession certificate
People use the two names as if they mean the same thing. They do not.
- A legal heir certificate is a revenue document from the Tahsildar that names the surviving legal heirs. It is used for a family pension, PF, gratuity, insurance claims, and transferring utility connections and simple assets. It is quick and cheap.
- A succession certificate is granted only by a civil court under the Indian Succession Act 1925. You need it to collect the deceased person debts and movable securities, such as bank balances, shares and fixed deposits, where the holder asks for court authority.
- A legal heirship certificate from the civil court (a declaration of heirs) is a third thing, used where title or shares are contested.
For most government benefit claims the Tahsildar legal heir certificate is enough. For bank securities and debts, the bank or company usually insists on a succession certificate.
02Documents you need
Keep clear scans ready before you start the e-Sevai request:
| Document | Why it is asked |
|---|---|
| Death certificate of the deceased | The trigger document; must match the name used elsewhere |
| Applicant Aadhaar and address proof | Identity of the heir applying |
| Family ration card | Shows the family unit |
| Self declaration or affidavit listing all heirs | The sworn list the Tahsildar verifies |
| Proof of relationship of each heir | For example Aadhaar, pension records, service records |
List every legal heir, not only the applicant. Leaving out a sibling or a second spouse is the most common reason a certificate is later challenged.
03Step by step on e-Sevai
The legal heir certificate runs on the Tamil Nadu e-Sevai portal, and the common access route is through an e-Sevai centre, though you can also apply yourself.
- 1. Get your CAN. On tnesevai.tn.gov.in create a login and a Citizen Access Number (CAN), which ties your records together.
- 2. Choose the service. Under the Revenue Department services, pick Legal Heir Certificate.
- 3. Fill the form. Enter the deceased person details, every heir with the relationship, and your address.
- 4. Upload documents. Attach the death certificate, the affidavit of heirs and the relationship proofs.
- 5. Submit and note the application number. The request goes to the Village Administrative Officer and Revenue Inspector for field verification, then to the Tahsildar to sign.
Field verification usually includes a visit or local enquiry to confirm the list of heirs, so give a reachable address and phone number.
04Fee, timeline and validity
The portal fee for a legal heir certificate is small, and an e-Sevai centre may add a service charge.
The timeline depends on how fast the VAO verification happens, and it is often a few weeks because the enquiry into heirs takes time. Track the status on e-Sevai with your application number. The certificate itself does not expire, but a bank or office may ask for a recent one, so keep the signed PDF and a couple of attested copies.
05Common reasons it is refused
Most refusals are about the list of heirs or the proof:
- Not all heirs listed, or a disputed heir left off.
- Death certificate name does not match the ration card or pension records.
- Weak proof of relationship for one heir.
- The matter actually needs a succession certificate (bank securities), which the Tahsildar cannot give.
If it is a documentation problem, correct it and re-apply. If the family does not agree on who the heirs are, or the asset is bank securities or a contested property, you move to the civil court, explained next.
06When heirship is disputed: the court route
The Tahsildar certificate works while the family agrees. It stops working the moment heirship is contested, a second marriage or a disowned child is claimed, or the asset is bank securities, shares or a debt that needs court authority. Then you move from the revenue department to the civil court.
For movable securities and the deceased person debts, you apply for a succession certificate before the district or civil court under the Indian Succession Act 1925. Where there is a Will, the executor may seek probate. Where heirship itself is fought, an heir files a suit for declaration and partition. These are court matters with notice to all heirs and, often, newspaper publication.

08Frequently asked questions
Which portal gives a legal heir certificate in Tamil Nadu?
The Tamil Nadu e-Sevai portal at tnesevai.tn.gov.in. You create a Citizen Access Number (CAN), pick the Legal Heir Certificate service under the Revenue Department, upload the death certificate and the affidavit of heirs, and the Tahsildar signs it after VAO verification.
Is a legal heir certificate the same as a succession certificate?
No. A legal heir certificate is a revenue document from the Tahsildar for pension, PF and simple transfers. A succession certificate is granted only by a civil court under the Indian Succession Act 1925 and is needed for the deceased person debts and movable securities.
How long does it take?
Often a few weeks, because the Village Administrative Officer verifies the list of heirs in the field. Track the status on e-Sevai with your application number.
What if a bank refuses the legal heir certificate?
Banks often insist on a court succession certificate for fixed deposits, shares and balances. For those you apply to the district or civil court under the Indian Succession Act, not to the Tahsildar.
What if the family disagrees on who the heirs are?
Then it is a court matter: a suit for declaration and partition, or a succession or probate proceeding. Claw can track that matter across the forum that hears it.
