How to Fight a Rejected Mediclaim (2026)
A rejected mediclaim feels like a dead end when you are already dealing with a hospital bill, but it is not. In India a health insurance rejection can be challenged through a clear ladder of steps, most of them free, and a large share of genuine claims are paid once they are pushed to the right desk. The first thing to do is get the rejection in writing and read the exact reason, because the reason decides your reply. This guide, for policyholders and their families, explains how to fight a denied cashless request or a rejected reimbursement, step by step, with the time limits and the evidence that works. It is general information, not legal advice. Last verified October 2026.
- Get it in writing: insist on a formal rejection or repudiation letter citing the policy clause before you reply.
- Cashless denial is not rejection: a denied cashless request can still be paid later as a reimbursement claim.
- Free ladder: insurer grievance officer, then the IRDAI Bima Bharosa portal, then the Insurance Ombudsman.
- Ombudsman: free, binding on the insurer, for claims up to Rs 50 lakh, within one year of the rejection.
- Consumer route: wrongful rejection is a deficiency in service under the Consumer Protection Act, 2019, with compensation possible.
01The short answer
You fight a rejected mediclaim by escalating in a fixed order:
- The insurer grievance officer, in writing, with a point by point reply to the stated reason.
- The IRDAI Bima Bharosa portal, if the insurer does not reply well or in time.
- The Insurance Ombudsman, a free forum that can order the insurer to pay, for claims up to Rs 50 lakh, within one year of the rejection.
- A consumer commission, for larger claims or where you also want compensation for the hardship caused.
Most genuine disputes are settled well before a consumer court, because the grievance and Ombudsman routes are quick and cost you nothing. The single most important move is to get the rejection in writing and answer the exact ground it gives.
02Cashless denial is not claim rejection
Many people panic when a cashless request is denied at the hospital desk. A cashless denial is not the same as a rejected claim. The third party administrator, or TPA, may refuse cashless approval because the papers sent at admission are incomplete or the treatment needs more documents, yet the same claim can still be paid later as a reimbursement.
So if cashless is denied, do not stop treatment and do not assume the claim is gone. Pay the hospital, keep every original bill, discharge summary and report, and file a reimbursement claim within the time your policy allows. A reimbursement rejection, in writing, is the point at which the fight in this guide actually begins.
03Step 1: read the rejection reason
Your whole reply is built around the exact ground the insurer gives. Common grounds for a health claim rejection in India include:
- Pre-existing disease and waiting period: the insurer says the illness existed before the policy or falls inside a waiting period.
- Non-disclosure: it alleges you did not reveal a material fact when buying the policy.
- Policy exclusion: the treatment is listed as not covered.
- Documentation or delay: missing papers or late intimation of the claim.
Insist on the reason in writing. If the insurer only says "claim rejected" on an app or a call, ask for a formal repudiation letter citing the policy clause. For a fuller view of why claims get refused and how to pre-empt each ground, see why health insurance claims get rejected.
04Step 2: the insurer grievance officer
Every insurer must have a Grievance Redressal Officer. Write to that officer with your policy number, claim number and a point by point reply to the stated ground. If they said pre-existing disease, attach the doctor note showing the condition was first diagnosed after the policy started. If they said non-disclosure, show the proposal form and what you actually declared.
Keep the complaint factual and attach copies, not originals. Note the date you sent it and keep the acknowledgement. The insurer is expected to respond within a set time, usually about 15 days. A clear, documented grievance resolves many rejections at this stage without any outside forum.
05Step 3: IRDAI Bima Bharosa
If the insurer does not reply within 15 days, or the reply does not satisfy you, escalate to the regulator. The Insurance Regulatory and Development Authority of India runs a grievance portal called Bima Bharosa (at bimabharosa.irdai.gov.in), where you register the complaint and track it.
IRDAI does not decide the claim like a judge, but it routes the grievance to the insurer and monitors the response, which often unblocks a stuck file. Lodging here also builds a dated record that helps at the Ombudsman or consumer stage if you still have to go further.
06Step 4: the Insurance Ombudsman
The Insurance Ombudsman is the most useful forum for most policyholders. It is free, runs under the Insurance Ombudsman Rules, 2017, and can pass an award directing the insurer to pay. It handles personal insurance disputes, including health, for claims up to Rs 50 lakh, a limit raised from Rs 30 lakh by a November 2023 amendment.
Two conditions matter. First, you should normally have taken up the grievance with the insurer first. Second, you must approach the Ombudsman within one year of the insurer rejecting the claim or the grievance. An award in your favour is binding on the insurer. For the step by step on this forum, see how to file an Insurance Ombudsman complaint.
Limits and timelines are set by rules and can change; confirm the current figures before filing.

07Step 5: the consumer commission
Where the claim is above the Ombudsman limit, or you also want compensation for the harassment and expense caused, a consumer commission is the route. A health insurance policy is a service, and wrongful rejection of a valid claim is a deficiency in service under the Consumer Protection Act, 2019.
You file at the tier set by the value: the District Commission for claims up to Rs 50 lakh, the State Commission above that up to Rs 2 crore, and the National Commission above Rs 2 crore. Consumer forums have ordered insurers to pay the claim with interest and costs in many wrongful rejection cases. The general ladder for any insurance type, not only health, is set out in how to dispute a rejected insurance claim.
08Evidence that wins
A mediclaim fight is won on documents, not on tone. Keep ready:
- The policy document and the proposal form you filled, to answer non-disclosure and exclusion grounds.
- The complete hospital record: admission notes, discharge summary, investigation reports and the treating doctor note on when the condition was first diagnosed.
- All bills and payment receipts, which also fix the value for the consumer tier.
- The written rejection and every grievance exchange, in date order.
A doctor certificate on the date of first diagnosis is often decisive against a pre-existing disease ground. Organise the file once, at the start, and the same bundle serves the insurer, the Ombudsman and the consumer commission.
09Where Claw fits
Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
Writing the grievance and arguing the claim is a task for you and, where needed, your adviser; Claw does not file it for you. Where Claw helps is in research and in tracking the dispute once it reaches a forum. Claw tracks consumer commission matters, Insurance Ombudsman led disputes and the resulting appeals to the State and National Commissions, the High Courts and the Supreme Court, across 9,102 courts, benches and forums, with alerts and monitoring, so a policyholder or an adviser sees every movement in a case. Its Legal GPT researches across 30 crore+ judgments, with Supreme Court decisions from 1950 and High Court decisions from 1990, so you can see how forums have decided comparable health claim rejections. Results return in under 5 seconds, and Claw does not train its AI models on your documents. To check an insurer existing litigation before you escalate, run a case search across Indian courts by company name. A clean result means nothing was found on the forums and date searched, and this is general information, not legal advice.

11Frequently asked questions
What should I do first when my mediclaim is rejected?
Get the rejection in writing and read the exact ground. Then collect your policy document, hospital bills, discharge summary and reports, and write to the insurer Grievance Redressal Officer with a point by point reply to that ground. The written reason decides your whole reply, so a vague app message or phone call is not enough. Ask for a formal repudiation letter citing the policy clause.
Is a denied cashless request the same as a rejected claim?
No. A third party administrator may refuse cashless approval at the hospital for incomplete papers, yet the same claim can still be paid later as a reimbursement. If cashless is denied, do not stop treatment. Pay the hospital, keep every original bill, discharge summary and report, and file a reimbursement claim within the policy time limit. A written reimbursement rejection is the point at which a real dispute begins.
How do I complain to the Insurance Ombudsman about a health claim?
First take up the grievance with the insurer. If it is not resolved, file a free complaint with the Insurance Ombudsman within one year of the rejection. The Ombudsman works under the Insurance Ombudsman Rules, 2017, handles personal insurance disputes including health for claims up to Rs 50 lakh, and can pass an award that binds the insurer. You can also lodge the grievance with IRDAI through the Bima Bharosa portal on the way.
Can I get compensation, not just the claim amount?
Yes, through a consumer commission. A health policy is a service, and wrongful rejection of a valid claim is a deficiency in service under the Consumer Protection Act, 2019. Consumer forums have ordered insurers to pay the claim with interest and costs. You file at the District Commission for claims up to Rs 50 lakh, the State Commission above that up to Rs 2 crore, and the National Commission above Rs 2 crore.
How do I fight a pre-existing disease rejection?
Answer the ground with a document. The strongest evidence is a treating doctor certificate on the date the condition was first diagnosed, showing it was detected after the policy started or outside the stated waiting period. Attach the proposal form to show what you declared when buying the policy. A rejection for pre-existing disease often fails where the insurer cannot prove the illness existed and was knowingly concealed when the policy was taken.
