How to Claim a Higher EPS Pension (and Appeal a Rejection)
A higher EPS pension means your Employees Pension Scheme 1995 pension is worked out on your actual higher salary instead of the old statutory wage ceiling, which can raise the monthly pension substantially for eligible members. The option became widely available after the Supreme Court's November 2022 judgment on higher pension, and EPFO opened a window on its member portal for eligible members and pensioners to validate the joint option with their employer. The process involves the member, the employer and EPFO, and many claims are delayed or rejected over the joint option, the wage proof, or the dues to be deposited. This page explains who is eligible, how the joint-option validation works on the EPFO portal, how the extra dues are calculated and transferred, the common reasons a claim is rejected, and the grievance and appeal route, including the EPF Appellate Tribunal, when EPFO says no. This is general guidance, not legal or financial advice. Last verified October 2026.

01What higher EPS pension means
The EPS 1995 pension is normally calculated on a capped pensionable wage. A higher pension lets eligible members have the pension computed on their actual higher salary, which usually means a bigger monthly pension, in return for a higher contribution to the pension fund (8.33 per cent on the higher wage) for the service period.
Because the extra pension comes from extra contribution, claiming it involves depositing or transferring the difference in dues from the provident fund to the pension fund, with interest. So it is both an entitlement question and a money calculation.
02Who is eligible
Broadly, the higher pension option is for members who were contributing on actual salary above the ceiling, or who had exercised or are entitled to exercise a joint option with their employer to contribute on actual salary, within the categories the Supreme Court and EPFO circulars recognise. In practice this includes:
- Members who were in service and contributing on higher wages and had a valid joint option.
- Certain members and pensioners who could validate the joint option in the window EPFO opened after the 2022 judgment.
Eligibility turns heavily on your service dates, whether a joint option existed, and whether you retired before or after the relevant cut-offs. Because the categories and cut-offs are specific, verify your own case against the current EPFO circular.
03Apply through the EPFO portal
- Step 1. Log in to the EPFO unified member portal at unifiedportal-mem.epfindia.gov.in with your UAN and password.
- Step 2. Open the higher pension / validation of joint option application link and fill the details of service and wages.
- Step 3. The application is routed to your employer for verification of the wage details and the joint option.
- Step 4. EPFO examines the validated application, works out the dues payable, and issues a demand or an order.
- Step 5. On payment or transfer of the dues, the pension is recomputed on the higher wage.
Keep your salary slips, PF statements and any joint-option record safe. Most rejections turn on missing wage proof or a disputed joint option, so the documents decide the claim.

04How the dues are worked out
Opting for higher pension is not free. EPFO computes the difference between what went into the pension fund at the capped wage and what should have gone in at the actual wage, usually with interest, across your service. That difference is:
- Transferred from your provident fund balance, where available, or
- Deposited by you if the PF balance is not enough.
Weigh the one-time cost of the dues against the rise in monthly pension before you commit, because for some members the extra pension justifies the dues and for others it does not. This is a financial decision as much as a legal one.
05Why claims get rejected
| Reason for rejection | What it means | What to do |
|---|---|---|
| No valid joint option on record | EPFO says you never opted to contribute on higher wages | Produce proof of the option or higher contributions actually made |
| Wage details not verified by employer | Employer did not confirm the salary history | Follow up with the employer; escalate if they do not respond |
| Retired before the relevant cut-off | EPFO says you fall outside the eligible category | Check your dates against the current circular and the judgment |
| Dues not deposited | The demand was raised but not paid | Pay or dispute the quantum of the demand |
Read the exact ground stated in the rejection, because the remedy (more proof, employer action, or a legal challenge) depends entirely on why EPFO said no.
06Grievance and the appeal route
A rejection is not the end. There is a clear escalation ladder:
- Grievance first. Raise the matter on EPFiGMS, the EPFO grievance system, and with the jurisdictional Regional Provident Fund Commissioner, with your documents.
- Statutory appeal to the Tribunal. An order of the EPF authority can be challenged under Section 7I of the EPF and Miscellaneous Provisions Act 1952 before the EPF Appellate Tribunal, the role now performed by the Central Government Industrial Tribunal cum EPF Appellate Tribunal (CGIT).
- Writ to the High Court. Where the action is without jurisdiction or contrary to the Supreme Court judgment, a writ petition lies before the High Court; many higher-pension disputes have been fought this way.
Confirm the current appellate forum and the limitation period on your order, because the tribunal structure under the Act has changed over time. For how a tribunal appeal is run in a comparable setting, see the DRAT appeal procedure.
07Track a rejected claim with Claw
Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
If your higher-pension claim is rejected and you take it to the EPF Appellate Tribunal or by writ to the High Court, that becomes a live legal matter with hearing dates and orders, and you can create a FREE Claw account to track it across the forum that hears it. Claw covers 9,102 courts, benches and forums, including the tribunals and the High Courts, so there is a real tracking home for the matter. Claw returns results in under 5 seconds, its judgment search spans 30 crore+ judgments (Supreme Court from 1950 and High Courts from 1990) so your advocate can see how similar higher-pension and EPF appeals were decided, and Claw does not train its AI models on your documents. A clean search result only means nothing was found on the forums and date searched, and this is general information, not legal or financial advice.
To see how similar matters were decided, run a case search across Indian courts. Auditors and advisors can use the same engine, see litigation search for auditors.

09Frequently asked questions
What is a higher EPS pension?
It is an EPS 1995 pension worked out on your actual higher salary instead of the statutory wage ceiling, which usually means a bigger monthly pension in return for higher contributions (8.33 per cent on the higher wage) for your service period. The option became widely available after the Supreme Court judgment of November 2022.
How do I apply?
Log in to the EPFO unified member portal at unifiedportal-mem.epfindia.gov.in with your UAN, open the higher pension or joint-option validation link, and fill your service and wage details. The application goes to your employer for verification, then EPFO works out the dues and issues an order, after which the pension is recomputed on payment.
Will it cost me money?
Yes. EPFO computes the difference between what went into the pension fund at the capped wage and what should have gone in at your actual wage, usually with interest, and that amount is transferred from your PF balance or deposited by you. Weigh this one-time cost against the rise in monthly pension before committing.
Why do claims get rejected?
Common grounds are no valid joint option on record, wage details not verified by the employer, retirement before the relevant cut-off, or dues not deposited. Read the exact ground stated, because the remedy, whether more proof, employer action or a legal challenge, depends on why EPFO said no.
Can I appeal a rejection?
Yes. Raise a grievance first on EPFiGMS and with the Regional Provident Fund Commissioner. An EPF order can then be appealed under Section 7I of the EPF and Miscellaneous Provisions Act 1952 before the EPF Appellate Tribunal (now the CGIT), and a writ lies to the High Court where the action is without jurisdiction or against the Supreme Court judgment.
Can I track a higher-pension appeal online?
Yes. Once a rejection becomes a tribunal appeal or a High Court writ, you can create a free Claw account and track it across the forum that hears it, with hearing dates and orders, and your advocate can search how similar higher-pension appeals were decided.
