Documents You Need Before Meeting a Legal Document Drafting Lawyer
A legal drafting lawyer charges mostly for time and judgement, so the more organised you are, the faster and cheaper the work gets. Whether you need a rent agreement, a power of attorney, a gift deed, a sale agreement or a partnership deed, walking in with the right papers means the advocate can start drafting instead of chasing basics. This guide lists exactly what to collect for the common legal drafting matters, what you do not need yet, and how to find and verify the right lawyer once you are ready.
- Carry: identity and address proof of every signatory, plus a short note of what you want drafted.
- By matter: title papers for a gift deed or sale agreement; capital and profit split for a partnership deed or MOU; owner proof for a rent agreement.
- Do not buy yet: stamp paper; stamp duty is set after the draft and goes to the state.
- Verify: ask for the advocate's Bar Council enrolment number; listed is not the same as entitled to practise.
- Fees: no fixed national rate; treat figures as ranges and confirm with the lawyer. Court and registration fees are separate.
- Free help: NALSA, SLSA and DLSA under the Legal Services Authorities Act, 1987 for those who qualify.
01Why documents decide how smooth drafting is
Most legal drafting problems are not about complex law. They are about missing facts. A lawyer cannot write a correct gift deed without the exact property description, and cannot draft a clean power of attorney without the right identity proof. When those are missing, you pay for extra meetings and the matter drags.
Good legal drafting is precise. The names, the dates, the amounts, the boundaries and the exact intention all have to be right, because the document has to hold up later if anyone questions it. So the first job before you meet any lawyer is to collect and check your own papers.
One rule for every document
Carry originals for the lawyer to see and photocopies to leave behind. Never hand over the only original of a property paper without a written acknowledgement.
02The core set every drafting matter needs
These basics apply whether you want a rent agreement, a power of attorney, an affidavit, a sale agreement, a partnership deed or an MOU.
- Identity and address proof of every person who will sign: Aadhaar, PAN, passport or voter ID. The lawyer needs the name spelled exactly as it appears here.
- Contact details of all parties, including the other side if you already know them.
- Two passport photos of each signatory for documents that need them.
- A short written note of what you want: the deal in your own words, the amounts, the dates, and the one or two things that matter most to you.
- Any earlier draft or related paper, even a rough one shared on WhatsApp.
This core set alone lets a lawyer start most legal drafting work the same day.
03Extra papers by type of document
On top of the core set, each matter needs a few specific papers.
| Document | Extra papers to carry |
|---|---|
| Rent agreement | Owner title or tax receipt, past rent agreement if any, agreed rent, deposit and term, list of fittings |
| Power of attorney | Exact details of the act you are delegating, property papers if it is a property power of attorney, identity of the person being appointed |
| Gift deed | Title documents of the property, latest tax receipt, relationship proof between donor and donee, encumbrance certificate |
| Sale agreement | Title chain, latest tax and utility receipts, approved plan, agreed price and payment schedule, encumbrance certificate |
| Partnership deed or MOU | PAN of each partner, capital contribution of each, profit sharing ratio, business address proof, nature of business |
| Affidavit | The exact fact you are swearing to, supporting proof of that fact, your identity proof |
If you are not sure which papers apply, carry whatever you have. A good legal drafting lawyer will tell you in the first meeting what is still missing.
04What you do NOT need to bring yet
People often delay a consult while they hunt for things that are not needed at the start.
- Stamp paper. The lawyer or the Sub-Registrar process tells you the correct stamp duty for your state after the draft is ready. Do not buy stamp paper in advance.
- Notarisation or registration. These come after drafting, not before. An affidavit is notarised, a gift deed and most sale deeds are registered at the Sub-Registrar office under the Registration Act, 1908.
- A finished draft of your own. A rough note of intent is enough. A half correct draft can cost more to fix than to write fresh.
Bring the facts and the originals. Leave the stamp duty, notary and registration steps to after the legal drafting is done.
05Verify the lawyer before you share papers
Before you hand your property or identity papers to anyone, confirm the person is actually an advocate who is allowed to practise. There are three different things people confuse.
- Listed: a name appears on a website or directory. Anyone can be listed. It proves nothing on its own.
- Verified: a platform has checked the person's identity and credentials. Better, but still depends on who checked and how.
- Entitled to practise: the person is enrolled with a State Bar Council under the Advocates Act, 1961 (Section 22 deals with the certificate of enrolment). Only an enrolled advocate can act for you.
Ask for the advocate's enrolment number and State Bar Council, and confirm it with that Bar Council. A clean profile is not the same as a verified enrolment.
06Typical fees and free options
There is no single government fixed fee for legal drafting in India. What a lawyer charges depends on the city, the lawyer's seniority and how complex your matter is. As a rough guide, a simple rent agreement or affidavit sits at the lower end, while a detailed sale agreement, partnership deed or MOU costs more because it needs careful clauses.
Treat any figure as a typical range that varies, and confirm the exact amount with the lawyer before work starts. Government charges like stamp duty and registration fees are separate and go to the state, not the lawyer.
If you cannot afford a private lawyer, free legal aid exists. Under the Legal Services Authorities Act, 1987 (Sections 12 and 13), the National, State and District Legal Services Authorities (NALSA, SLSA and DLSA) give free legal help to those who qualify, such as women, children, people with low income and others listed in Section 12. Visit your District Legal Services Authority or nalsa.gov.in to check if you qualify.

07How Claw helps you find the right lawyer
Once your papers are ready, the next step is finding an advocate who actually handles legal drafting for your kind of matter. Claw helps you do that.
Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
For finding a lawyer, Claw connects you with a verified, independent advocate who handles your area, in your state or city where possible. You describe the matter in a short guided chat, whether it is a rent agreement, a power of attorney, a gift deed, a sale agreement or a partnership deed, and Claw matches you to a relevant advocate end to end: understand the problem, identify the right kind of lawyer, check that the person is enrolled, and arrange an online or in-person consultation. You can send a free basic request, or choose Rs 99 priority for faster matching.
Claw does not hire, employ or empanel lawyers and is not a law firm. The advocate is independent, and the advocate's professional fee is paid directly to that advocate and is not shared with Claw, in line with Bar Council of India Rule 36. Claw is a technology platform that helps you find and reach the right advocate; it is not your advocate and does not give legal advice. You can start at Claw Find a Lawyer.
08Frequently asked questions
Do I need stamp paper before meeting a legal drafting lawyer?
No. Buy stamp paper only after the draft is ready, because the correct stamp duty depends on the document and your state. A rent agreement, gift deed and sale agreement each attract different duty. The lawyer or the Sub-Registrar process will tell you the right amount.
What identity proof is needed for a power of attorney?
Carry Aadhaar, PAN or passport of both the person giving the power of attorney and the person being appointed, along with the exact details of the act being delegated. If it is a property power of attorney, also bring the property papers.
Can legal drafting be done online without meeting in person?
Much of it can. A lawyer can prepare a rent agreement, an affidavit, a partnership deed or an MOU from documents and details you share online. Some steps still need physical presence, such as registration of a gift deed or sale deed at the Sub-Registrar office, and swearing an affidavit before a notary.
How do I check if my drafting lawyer is genuine?
Ask for the enrolment number and the State Bar Council, then confirm it with that Bar Council. Enrolment under the Advocates Act, 1961 is what entitles a person to practise. Being listed on a website or verified by a platform is useful but is not the same as being an enrolled advocate.
Is there free help for legal drafting if I cannot afford a lawyer?
Yes. Under the Legal Services Authorities Act, 1987, NALSA and the State and District Legal Services Authorities give free legal help to people who qualify, including women, children and low income applicants. Apply at your nearest District Legal Services Authority or through nalsa.gov.in.
What if I already have a rough draft?
Bring it. Even a rough note or a draft shared on WhatsApp helps the lawyer understand your intention. Just be ready for the lawyer to rewrite it, because a document that is half correct can sometimes take more time to fix than to draft fresh.
