Disciplinary Proceedings May Run Alongside A Criminal Case, Court Holds

A Food Corporation of India employee got departmental proceedings against him stayed until a CBI case over forged recruitment papers was decided. The Chief Justice's bench has lifted that stay.

The short answer

The Court held there was no bar on the departmental proceeding continuing while the criminal case is pending. The employee was not even named in the FIR, the criminal trial had not yet begun, and it was premature to say the charges, material and witnesses in both were the same. The Single Judge's order was set aside; the employee may defend himself in the inquiry.

What changed
  • Parallel proceedings are the rule. A stay needs a real showing of prejudice.
  • He was not named in the FIR, which weakened the claim that both cases were identical.
  • The criminal case had not started, so overlap could not be assumed.
  • Natural justice still applies in the inquiry, the Court stressed.

Writ appeal allowed; stay on departmental proceeding set aside

The background

The respondent joined the Food Corporation of India as a watchman in 2019 and was later promoted. In September 2024 the CBI registered a case over forged signatures in test documents from a watchman recruitment in the Odisha region, naming five candidates and unknown officials.

The respondent was not named in the FIR, but the Corporation began departmental proceedings against him in August 2025. He argued the charges, witnesses and documents were the same as in the criminal case, and that defending himself in the inquiry would expose his defence.

A Single Judge stayed the inquiry until the criminal case ended.

Why the stay was lifted

The Division Bench held that when the criminal case had not even commenced, it was preposterous at that stage to say that the allegations, material and witnesses in the two proceedings were the same.

The respondent would have every opportunity to defend himself before the disciplinary authority, including on the charges and list of witnesses. The Single Judge's order could not stand.

The result

The appeal was allowed and the stay set aside. The Corporation may proceed with the inquiry, the employee may file his written defence, and the authorities must follow the principles of natural justice and conclude it in accordance with law.

Who argued it

Appearances as recorded in the judgment of the Court.

Frequently asked

Must departmental proceedings wait for the criminal case?

Not ordinarily. The Court allowed the inquiry to continue here.

Does it matter that I am not named in the FIR?

It weakened the argument that both proceedings were identical.

Seeking a stay of disciplinary proceedings

  1. Show specifically how the charges, witnesses and documents overlap.
  2. Explain the complex questions of fact or law involved.
  3. Show real prejudice to your criminal defence, not a general fear.
  4. Expect little success if the criminal trial has not begun.
