Builder Delay in Possession: Your Rights and Remedies (2026)
What a homebuyer can do when a builder delays possession: claim interest and keep the flat, or exit with a refund and interest, and which forum to use. Last verified October 2026.
How-to · Real Estate · RERA
A builder who misses the possession date agreed in your sale agreement is in breach, and the law gives you a clear choice. You can keep the flat and claim interest for every month of delay, or you can walk away with a full refund plus interest. This guide explains those rights, how the interest works, and which forum to use. Last verified October 2026.
- Core right: under Section 18 of RERA, a buyer facing delay can keep the flat and claim interest, or exit with a full refund and interest.
- The choice is yours: the builder cannot force you to wait; you decide to stay or leave.
- Interest: at the rate set by your state RERA rules, for the period of delay.
- Forum: RERA or the consumer commission; the Supreme Court allows the buyer to choose.
01What counts as delay
Delay is measured against the date for possession written into your agreement for sale, not a vague oral promise or the brochure. If the builder has not offered lawful possession by that date, the delay clock starts.
Lawful possession usually means possession with the completion or occupancy certificate, so that you can actually live in the flat. A bare offer of keys for an incomplete building, without the required certificate, is often not treated as valid possession.
02Your two choices under Section 18
Section 18 of RERA is the key provision. When the builder fails to give possession on time, the buyer can choose one of two paths:
- Stay and claim interest. You keep the booking and the flat, and the builder pays you interest for every month of delay until possession is handed over.
- Exit and claim a refund. You withdraw from the project and the builder returns the entire amount you paid, with interest.
The choice is the buyer's, not the builder's. You decide whether to stay for the flat with interest, or to leave with your money back and interest.
03How the interest is calculated
The interest rate is the one set by your state's RERA rules. Many states fix it by reference to a bank's benchmark lending rate plus a margin, so that the rate the builder pays you matches the rate you would be charged on the same amount.
Interest runs for the period of delay. If you stay, it is paid for each month from the agreed possession date until actual possession. If you exit, it runs on the refund amount. Check your state's rule for the exact rate and the start date.
04When you can get a full refund
You do not have to prove the delay is permanent to exit. The right to a refund with interest arises when the builder fails to hand over on time and you choose to withdraw. You are not forced to wait indefinitely for a project that keeps slipping.
That said, courts and authorities look at the facts. A very short delay, a delay caused by a genuine force majeure event, or your own default on payments can affect the outcome. Keep your own payments current so the builder cannot blame you.
05Which forum to use
You usually have a choice of two forums:
- RERA: a complaint to your State Real Estate Regulatory Authority. See the RERA complaint procedure. It is real-estate specialised and tends to move quickly.
- The consumer forum: a complaint for deficiency in service before the District, State or National Commission, chosen by value.
The Supreme Court has held that RERA does not take away the consumer remedy, so a buyer can choose. You cannot run both for the same relief at the same time, so pick the one that fits your goal.
06Evidence to keep
Build a clean file before you file:
- the agreement for sale, showing the possession date;
- all payment receipts and the demand letters you paid against;
- the project RERA registration number;
- any letters or emails where the builder admits or explains the delay; and
- a simple timeline of promised versus actual dates.
Clear documents make the interest or refund calculation straightforward, which speeds up the order.

09Frequently asked questions
What can I claim if my builder delays possession?
Under Section 18 of RERA you have two options. You can keep the flat and claim interest for every month of delay until possession, or you can withdraw and claim a full refund of what you paid, with interest. The choice is the buyer's.
How is the delay interest calculated?
At the rate fixed by your state's RERA rules, which many states set as a bank's benchmark lending rate plus a margin. If you stay, it is paid for each month from the agreed possession date to actual possession. If you exit, it runs on the refund amount.
Can I get a full refund, or only interest?
You can get a full refund with interest if you choose to withdraw because the builder failed to give possession on time. You are not forced to wait indefinitely, though a very short delay, genuine force majeure, or your own payment default can affect the outcome.
Should I go to RERA or the consumer forum?
You can usually choose, because the Supreme Court has held that RERA does not take away the consumer remedy. RERA is real-estate specialised and quick; the consumer forum is a familiar route for deficiency in service. You cannot pursue both for the same relief at once.
What if I missed a payment to the builder?
Keep your own payments current. A builder may try to blame the buyer's default for the delay. If you are up to date, that defence falls away, and your claim for interest or refund is cleaner.
Can Claw help track a delay case?
Yes. Claw searches 30 crore+ judgments to show how interest and refunds were decided in similar projects, returning results in under 5 seconds, and tracks a live possession matter by its cases, orders and hearings under a party or advocate name across 9,102 courts, benches and forums. It tracks and researches the matter but does not give legal advice.
